Must Know! This is the Risk of Over Crediting Vehicles Without Leasing Permits

Many things are done during difficult economic times like today. To keep the kitchen smoking, it is not uncommon for people to finally let their vehicles change hands. When the vehicle is still a guarantee of a financing company, the practice is called over credit. This is done when the first party is no longer able to complete the installments until they are paid off, then hand over the vehicle to another person who can pay it off in full. It's just that not many people know that this practice is actually against the law, especially if it is done without the knowledge and permission of the leasing party, aka underhand. This is contrary to the financing agreement in the clause on rights and obligations over goods. for anyone caught reselling or over crediting illegally, both the seller and the buyer can be subject to criminal sanctions. This act violates Article 372 of the Criminal Code: "Anyone who intentionally and unlawfully owns something that is wholly or partly owned by another person, but which is in his control not because of a crime is threatened because of embezzlement, with a maximum imprisonment of four years or a maximum fine of nine hundred thousand rupiah". Not to mention being entangled in Article 36 of Law Number 42 of 1999 concerning Fiduciary Guarantees, with a maximum criminal penalty of two years and a maximum fine of IDR 50 million. As for the buyer, he is also subject to Article 480 of the Criminal Code concerning receiving goods with a maximum prison sentence of five years or a maximum fine of IDR 900 thousand.
For that, submit a vehicle over-credit to an official leasing company, so that there is a notification of the transfer of credit to another person who will pay off the remaining installments. That way, you can avoid the risk of being entangled in the law as previously mentioned.
